INFORMATION STATEMENT ON PRIVACY PURSUANT TO ART. 13 OF REGULATION (EU) 2016/679

This information statement is provided in compliance with the provisions of Article 13 of Regulation (EU) 2916/679 on the protection of individuals with regard to the processing of personal data.
This information statement pertains to the processing of data collected through www.caracol-am.com in a transparent and organised manner.

There is a specific page on the site dedicated to the collection of job applications, to which is dedicated a specific information statement.

Identity of the Data Controller

The Data Controller is Caracol Srl Via Cavour, 2 Lomazzo 22074 (CO).
Co-Controller pursuant to Article 26 of the GDPR Caracol Inc (Texas) – 1800 West Loop South – Suite 1740 – Houston, TX 77027

Purpose of the processing

The processing may be aimed at two specific aspects (easily identifiable by the data subject at the time of data collection on specific forms) in any case related to his or her activities of Large-scale 3D Printing, Robotics and Automation, Additive Manufacturing solutions without scale limits:

  • a) Handling of requests for contact with the data controller
  • b) Subscription to the Newsletters service offered by the Data Controller

The data controller reserves the right to collect data for other purposes subject to the provision of appropriate information statements and the collection of specific consents if necessary for the lawfulness of the additional processing operations.

The use of the collected data for marketing purposes is not envisaged, unless specific consent is obtained at a later stage, which is understood NOT to be given at the moment.

Legal basis for the processing

The Controller identifies the following legal basis that legitimises the processing of the personal data:

  • – the processing is necessary for the performance of a contract to which the data subject is party or for the performance of pre-contractual measures taken at the data subject’s request (Art. 6, paragraph 1, letter b),

For these reasons, the processing is not subject to the consent of the data subject.

Data processed

The data processed will be of an exclusively personal nature (name, surname, e-mail address, and, for the contact form, other identifying data)

Duration of the processing

The data acquired will be processed by the data controller for the time necessary to ensure the proper fulfilment of the above-mentioned purposes.

The Data will be retained until the fulfilment of the specific requests of the data subject for the purpose under a)

The Data will be retained until subscription to the Newsletters service for the purpose under b) is revoked

Any further retention may take place for additional purposes that are the subject of specific information statements.

External disclosure of the data

The personal data acquired may be disclosed externally at the request of the competent authorities; in addition, the data may be disclosed to subjects defined as Data Processors pursuant to Article 28 of the GDPR when the same are instrumental for the achievement of the purposes described above.

Transfer of the personal data outside the EU

There are no plans to transfer the data outside the EU.

Rights of the data subject

The data subject, in relation to the personal data provided, is entitled to exercise the following rights envisaged by the EU Regulation:

  • – Right of the data subject to access (Art.15 of Regulation (EU) 2016/679);
  • – Right to rectification (Art. 16 of Regulation (EU) 2016/679);
  • – Right to erasure (Art.17 of Regulation (EU) 2016/679);
  • – Right to restriction of processing (Art.18 of Regulation (EU) 2016/679);
  • – Right to data portability (Art.20 of Regulation (EU) 2016/679);
  • – Right to object (Art. 21 of Regulation (EU) 2016/679).

The data subject also has the right to withdraw any consent given at any time. These rights may be exercised in writing or by sending an e-mail to privacy@caracol-am.com

The data subject also has the right to lodge a complaint with the Italian Data Protection Authority.

Nature of data provision

Please note that, with regard to the above-mentioned purposes, the provision of personal data by the data subject is necessary and that a refusal to provide such data will make it impossible for the data controller to continue with the specific purposes.

Means of processing

The personal data will be processed in hard copy and in computerised form and entered into the relevant databases, which may be accessed, and thus come to the knowledge of, employees, collaborators, and appointees of the data controller. These parties may carry out operations of consultation, use, processing, comparison and any other appropriate (including automated) operations, in compliance with the provisions of the law necessary to guarantee, among other things, the confidentiality and security of the data, as well as their accuracy, update, and relevance to the purposes stated.
